Terms of Service

These Terms of Service ("Terms") govern the purchase of products and services through the website faga.bio. Applicable law: Croatian Consumer Protection Act (NN 41/14 et seq.), Obligations Act (NN 35/05 et seq.), and EU consumer law.
1. Seller

2. Scope
These Terms apply to all orders placed through faga.bio between Seller and Buyer (consumer or business). By placing an order, the Buyer confirms having read and accepted these Terms at the time of order.
3. Conclusion of Contract
The display of products on the website constitutes an invitation to the Buyer to make an offer. The contract is concluded when the Seller confirms acceptance of the order by email ("Order Confirmation"). An automatic acknowledgment of receipt is not a legal confirmation of contract. The Seller reserves the right to refuse orders (e.g., due to stock unavailability) with timely notice to the Buyer.
4. Prices
All prices are quoted in Euro (EUR), include applicable VAT (25% in Croatia), and exclude shipping costs. Shipping costs are displayed at checkout before order finalization. Prices in effect at the time of order apply. The Seller reserves the right to change prices; changes do not affect already-confirmed orders.
5. Payment
We accept the following payment methods:
- Credit card (Visa, Mastercard, American Express) via Stripe — secure PCI-DSS processing
- SEPA bank transfer (IBAN available on request)
- Cash on delivery (Croatia only, +3.99 EUR surcharge)
For card or SEPA payments, the order is confirmed upon receipt of payment. For cash on delivery, the order is shipped immediately.
6. Shipping and Delivery Times
Delivery area: Croatia, Slovenia, Bosnia and Herzegovina, Serbia, Montenegro, Germany, Austria, Hungary. For other EU countries, please inquire before ordering.
Shipping costs: 4.99 EUR flat rate for all countries (Croatia and EU). Free shipping for orders over 50 EUR.
Delivery times:
- Microgreens (live): 1-2 business days (Croatia only)
- Seeds, shilajit, CBD, ashwagandha: 2-5 business days (Croatia), 5-10 (EU)
Delivery times are non-binding and start with payment receipt. Delays due to force majeure (weather, postal strikes, etc.) do not constitute breach of contract.
7. Right of Withdrawal for Consumers
Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the goods.
7.1. Exercising the Right of Withdrawal
To exercise the right of withdrawal, you must inform us (INDI vl. Monika Kunstek, Drašković 3 A-D, 42220 Novi Marof, email: info@indi-24.de) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter or email). You may use the model withdrawal form (below), but it is not obligatory.
7.2. Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of delivery other than the cheapest standard delivery), without undue delay and not later than 14 days from the day on which we are informed of your decision to withdraw. We will use the same means of payment as you used for the initial transaction. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent the goods back.
7.3. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:
- Goods that are perishable or have a short shelf life (fresh microgreens)
- Goods customized to consumer specifications
- Sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been broken after delivery (e.g., opened shilajit, CBD, ashwagandha)
7.4. Model Withdrawal Form

"I/We hereby give notice that I/we withdraw from my/our contract for the purchase of the following goods: [name]. Ordered on: [date]. Received on: [date]. Name of consumer(s): [name]. Address: [address]. Signature (only if this form is notified on paper): [signature]. Date: [date]."
8. Defect Liability and Warranty
The Seller is liable for material defects of products in accordance with Art. 400-422 of the Croatian Obligations Act. Period for notifying hidden defects: 2 years from receipt. In case of defects, the Buyer may demand: defect rectification, replacement, price reduction, or contract rescission. Send defect reports to info@indi-24.de with description and photos. Response within 15 days.
9. Liability
The Seller is liable for damages caused by intentional or grossly negligent conduct. Liability for slight negligence is excluded, except for injury to life, body, or health. The Seller's liability is limited to the value of the order (except in cases prescribed by law).
10. Data Protection
Personal data processing is governed by our Privacy Policy, which forms an integral part of these Terms.
11. Dispute Resolution
All disputes between Seller and Buyer shall be governed by Croatian law, excluding the rules of international private law. Place of jurisdiction: the materially competent court in the Republic of Croatia. EU consumers may use the Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.
12. Final Provisions
If any provision of these Terms is invalid, the remaining provisions remain in effect (severability clause). The Seller reserves the right to modify the Terms. Modifications are published on this page; the effective date is indicated at the top.
